Wicklow Pair Avoid Jail Over Dark Web Firearms Case

Wicklow friends receive suspended sentences for possessing firearms which had been bought by their friend on the dark web two years ago.

Two young men from west Wicklow have received fully suspended prison sentences after admitting possession of firearms purchased on the dark web.

At Naas Circuit Court, 22-year-old Shane Kinsella of Kiltegan and 22-year-old Daniel Quinn Burke of Baltinglass were each handed down three-year sentences, but suspended in full for five years.

The court heard the pair pleaded guilty to possessing a rifle, a semi-automatic pistol and ammunition in March 2024 at a location near Straffan in north Kildare.

Weapons linked to deceased third man

The firearms had been sourced on the dark web by a third man, Evan Fitzgerald, who later died following an incident in Carlow. Charges against him were subsequently withdrawn.

The case drew attention locally in west Wicklow, particularly in Kiltegan and Baltinglass, where both men are from.

Judge says its “utterly ludicrous”

Presiding judge Elva Duffy described the circumstances as “utterly ludicrous”, while also noting the case was highly unusual.

The court heard that both men had no previous convictions and became involved out of loyalty to their friend.

Judge Duffy said she took all factors into account before deciding a custodial sentence was not warranted, instead imposing fully suspended terms.

While the case has raised concerns around the accessibility of weapons online, the outcome is likely to be closely noted across Wicklow, where both men are known locally.

The suspended sentences mean neither man will serve time in prison, provided they comply with the conditions set down by the court over the next five years.
